BEFORE YOU FILE
This application extends the status you hold now. It does not change your status. Moving from one status to another, for example to H-4, is a different request. Students (F-1, M-1), exchange visitors (J-1, J-2), principal workers, and Visa Waiver visitors are not covered. Everyone applies on their own: family members cannot be added to your application.

Common questions
Form I-539 questions, answered
What it is, what it costs, where to send it, and when to file.
It is the USCIS Application to Extend/Change Nonimmigrant Status. People use it to ask for more time in the United States in the status they already hold. Immiva prepares the extension only. It does not prepare a change of status. USCIS Form I-539 page
The USCIS fee is $470 when you file on paper, per the G-1055 fee schedule (edition 10/26/26). Immiva's preparation fee is $99, paid after you see your completed forms. The two are separate.
The address depends on your status and where you live. Your Immiva filing instructions name the right one. USCIS also lists every address on its I-539 page. USCIS I-539 filing addresses
Processing times change often and depend on the office that handles your case. Check the current estimate before you file. USCIS processing times
Not through Immiva. We prepare a paper packet that you print, sign, and mail. Your instructions list what goes in the envelope.
It is a supplement for family members who apply on the same I-539. Immiva supports one applicant per application, so each family member files their own.
Before the authorized stay on your I-94 ends, and while you are still keeping the rules of your status, including not working without authorization (8 CFR 214.1(c)(4)). Your passport must also stay valid for the whole stay you ask for, as the Form I-539 instructions require. 8 CFR 214.1
USCIS excuses a late filing only if the delay came from extraordinary circumstances beyond your control, the delay was reasonable, you broke no other rule of your status, you are still a genuine temporary visitor, and you are not in removal proceedings. It is not automatic. We flag a late filing in your report. That is the point to talk to a lawyer.
What a pending request lets you do is set by USCIS, and it depends on your status. Read the USCIS Form I-539 page before you travel or rely on it, and talk to a lawyer if you have a question about your situation. USCIS Form I-539 page
The form can be used for that, but Immiva prepares extensions only. For a change to H-4 status, use our H-4 change of status page. H-4 change of status
Yes, if you are in B-1 or B-2 status. USCIS extends a visitor's stay by up to 6 months at a time. A year is allowed only for missionary work (8 CFR 214.2(b)(1)). Extend a tourist visa stay
If you are in removal proceedings, if you worked without authorization, or if the date on your I-94 has passed. If your answers point to one of these, we say so, and that is the point to talk to a lawyer.
