The short answer

Who can file for a K-3 spouse visa?

A U.S. citizen with a spouse abroad can file Form I-129F for a K-3, with a Form I-130 for that spouse. Mail the I-130 first, then the I-129F with a copy of its receipt notice. If the I-130 is approved first, the K-3 case is usually closed and the spouse continues on an immigrant visa.

  • Your spouse applies for the visa in the country where the marriage took place

The check

What this eligibility check covers

  1. Whether you are a U.S. citizen, since only a citizen files for a K-3
  2. Whether you and your spouse are already legally married
  3. Whether a Form I-130 for the same spouse is filed or ready to mail first
  4. Criminal history and immigration court proceedings
  5. Whether your spouse is already in the U.S., which fits the I-485 path
  6. An engaged couple, who belong on the K-1 check instead
