READ FIRST
This waiver needs a final divorce or annulment. Separated or still in divorce proceedings is not enough on its own. If you filed a joint petition and the divorce becomes final while it is pending, USCIS lets you ask to change it to a waiver. We explain which situation is yours.
Where you are in the divorce
Which situation matches yours?
The right move depends on how far the divorce has gone. The free eligibility check confirms which one is yours.
- 01
Divorce or annulment is final
You file the I-751 alone with the waiver, your final decree, and evidence the marriage was genuine. You do not need to wait for the 90-day window.
THIS PAGECheck eligibility - 02
Separated or divorce still pending
A separation alone is not a basis for this waiver. USCIS generally sends a Request for Evidence asking for the final decree, and a divorce that ends during the response period can still qualify.
NOT YET A WAIVERCheck eligibility - 03
Abuse during the marriage
A waiver based on battery or extreme cruelty is a different filing with its own evidence. Immiva does not prepare it. Our check sends you to an immigration attorney.

Common questions
I-751 divorce waiver, answered
What people ask when a marriage ends before the conditions come off.
The I-751 normally has to be filed jointly with your spouse. If you married in good faith but the marriage ended by divorce or annulment, you can ask USCIS to waive the joint filing requirement and file by yourself. You still have to prove the marriage was genuine when it began.
As soon as the divorce or annulment is final. You do not have to wait for the 90-day window before your card expires. USCIS accepts this waiver before, during or after that window. If your card has already expired, tell us. We flag it, and a card that expired more than a year ago goes to an attorney.
Not as a divorce waiver. A separation alone is not a basis for it. If you file anyway, USCIS generally issues a Request for Evidence for the final decree. If you filed a joint petition and the divorce finishes while it is pending, you can ask USCIS to change it to a waiver. Contact the office on your receipt notice.
USCIS does not publish an approval rate for this waiver, and we will not invent one. What decides your case is the evidence that the marriage was real when you entered it, not who ended it.
It can. USCIS decides case by case whether to approve on the paperwork, ask for more evidence, or call you in for an interview. A clear decree and strong marriage evidence give an officer less reason to ask questions. We cannot promise either outcome.
Shared finances, a shared home, children, insurance, travel, photos, and statements from people who know you both, covering the time from the wedding to the separation. You do not need to show that you are still together, and it does not matter who left or who filed for divorce. See the I-751 evidence checklist
There is a separate waiver for battery or extreme cruelty. Immiva does not prepare it. Our check routes you to an immigration attorney, because the evidence and the confidentiality rules are specialized.
Once your conditions are removed you hold a 10-year green card, and you apply on the standard 5-year path. The 3-year marriage rule needs you to still be married to your citizen spouse. See the N-400 page
Immiva's fee is $149, paid once, after you have seen the report. The USCIS filing fee is separate and goes to the government.
